When a spouse dies, the remaining husband or wife is not responsible for their debts unless they signed an obligation to those debts. A creditor or even a debt collector will often place the debt on the remaining spouse's credit report in an effort to get the debt paid. This is illegal under both the FDCPA and the fair credit reporting act.
