The collector is demanding I pay by post-dated check. What are my rights?

As part of a settlement with a debt collector, the debt collector will commonly ask for the debtor to give them post-dated checks. You can not be compelled to do this. If you do authorize the debt collector to use post-dated checks, the law requires that they tell you within ten days of their intent to cash those checks. Often times debt collectors won't do that. When they don't tell you they are about to take money from your bank account, and don't provide you notice under the FDCPA, that's illegal and against the law.
