			<content:encoded><![CDATA[<p align="justify">The Fair Debt Collection Practices Act (FDCPA) was developed to protect consumers from being harassed by the collection agencies. Its other purpose was to level the playing field for debt collection agencies that followed the law.</p>

We see fear and harassment as part of the DNA of a lot of the agencies we sue. We turn the thing around and let them worry for a while as we come after the bad debt collector with the power of the Federal Law.</p>

<p align="justify">Whether you owe a debt or not, you should not suffer at the hands of a collection firm that uses intimidation and bullying tactics instead of working with each debtor within their means. When the debt collector crosses the line we act fast for our clients in giving them peace of mind and comfort that only the power of the FDCPA (and your state collection statute) can bring in cleaning up the bad guys.</p>
<p align="justify">Just hiring us is the best first step. Once you hire an attorney, the collection company is not allowed any further contact. Some inherit it and do not add to it, tilting the scales for the ones who are successful in multiplying the inherited wealth and stay on the top. The rich are more in debt than we tend to think. While the middle class borrow to maintain their lifestyles and to pay the bills, <strong><span style="font-weight: normal; font-family: Verdana;">the wealthy use debt to expand their wealth.</span></strong> Most rich people are not <a rel="nofollow" target="_blank" href="http://moneyliving.blogspot.com/2007/01/being-debt-free-isnt-always-all-its.html"><span style="text-decoration: none; color: #000000;">debt-free</span></a>. The middle class and many lower-income Americans rely on credit cards and home-equity and other loans to meet living costs. You are not rich; it is OK, to certain extent. Low interest rates have augmented their leveraging capacities and their wealth.</span></p>

But the modern day economics offered it as a powerful tool to change the face of the financial world. The precedence set by the modern rich-folk indebtedness has glorified borrowing. The breed of this rich individual actually established it as the ability of taking advantage of the leverage it offers rather than an inability to pay ordinary bills. Look at the big picture. You pay the interest on the debt al right, but then you are gaining higher returns on money you borrowed for an investment. </span></p>

<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">When Creditors/lending institution decide to write-off an account, they take a tax credit, based not only on the alleged transfers for the goods/services, but also on the interest and fees accrued.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">They, then sell the Rights of Collection to a third-party debt collector for a fraction of the actual value of the debt. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">The real price would be around 10-20 cents per dollar.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">The third party <strong><a href="http://www.collectionstopper.com">debt collector</a> </strong>now employs many strategies that have been perfected to an art form to extract money from the alleged debtor. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">Their initial contact is by telephone.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">When a telephone is answered it is deemed an invitation for the other party to speak. If it is a debt collector calling, speaking to him would deem it consent to getting into business with him.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">In fact there is no law, code, or statute that can make you enter into any conversation/agreement that you do not consent to. </span></p>

<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">JUST<strong> HANG-UP,</strong> if you decide against getting into a conversation with the caller.</span></p>

<p class="MsoNormal" style="text-align: justify;"><span style="text-decoration: underline;"><span style="font-size: 10pt; font-family: Verdana;">Now that the debt caller had failed to make contact with you at home he will try to call you at your place of work.</span></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">This way he intends to condition you to enter this supposedly new scheme by embarrassing and intimidating you at which point most people break and contact the Debt collector. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">Once this contact is made or an offer is accepted for a so called reduced balance or rate of interest, the birth of a new debt is complete. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">This is all because you <strong>were not</strong> aware of your collection rights.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="text-decoration: underline;"><span style="font-size: 10pt; font-family: Verdana;">Should the debt collector fail to make contact by telephone within a week or two he would send “The Letter”.</span></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="text-decoration: underline;"><span style="font-size: 10pt; font-family: Verdana;"><span style="text-decoration: none;"> </span></span></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">This is an attempt to show that the law/system is on his side so that he can convert a debt that no longer does exist, into a fresh one.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">In his letter he would say that:</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="text-decoration: underline;"><span style="font-size: 10pt; font-family: Verdana;"><span style="text-decoration: none;"> </span></span></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">1. This is an attempt to collect a debt, and any information will be used for that purpose. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">2. The letter is from a debt collector.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">3. You have 30 days to dispute the validity of the debt, or any part of it.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">4. If such dispute, demand for validation, or request for information on the original creditor is not made the debt will be considered valid. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">5. When a demand/request in writing is made within 30 days, for verification, or a copy of a judgment it will be provided. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">The next/sixth warning is usually found at the bottom or on the back of the letter.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">It is sometimes in microscopic print or in a light unreadable shade of gray that discourages you from reading it. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">6. The name and address of the original creditor will be given, if the name is different from the current creditor. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><strong><span style="font-size: 10pt; font-family: Verdana;">The debt collector is silently praying that you would never get to know the relevance or the true meaning of what he wrote.</span></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><span style="font-size: 10pt; font-family: Verdana;"> </span></strong></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">1. &#8220;<span style="text-decoration: underline;">That this is an attempt to collect a debt</span>”, in fact means despite the fact that you and he are total strangers and you owe him nothing, he intends to extract money from you. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt; font-family: Verdana;">He also means that you should take it as an advance warning and he would leave nothing to chance in squeezing money out of you and make your life miserable. </span></p>

<p style="text-align: justify;">When you have been harassed by a debt collector, the first thing you must do is, to determine whether the collector is the original creditor, a collection agency or a company that bought the debt. Collection agencies and attorneys who are regularly engaged in collecting debts must comply with Fair Debt Collection Practices Act and the respective states’ Debt Collection Act. The original creditor is generally not liable under the FDCPA unless they are holding themselves out as a collection agency or if the owner of a debt acquires it after the debt default.</p>
<p style="text-align: justify;">Assess the type of debt you owned. You may be protected under FDCPA, if the debt collector is attempting to collect a consumer debt such as a utility bill, car payment, home mortgage etc.</p>
<p style="text-align: justify;">Prior to filing a lawsuit against the debt collection agency under FDCPA, see if you have any witness to harassment against you. Ask the debt collectors to send the notarized statements with in five days of the collector’s initial communication by phone. <p style="text-align: justify;">(1) If the debt collector is calling upon you in Michigan, Florida, Californian or Nevada right now, they have room to cut and negotiate because they know the economy in those states means there is little money. That is just an economic fact so get to finally use the bad economy for something good!</p>
<p style="text-align: justify;">(2) The higher the debt, the money room to cut. Again, see Number 1 and also know that generally the debt collector will not get a commission (that is how they get paid) or meet their monthly quota if they don’t deal.</p>
<p style="text-align: justify;">(3) If the debt collector owns the debt they have probably paid 5 to 10 cents on the dollar so they can sometimes negotiate the debt way down. Again, find out if the debt collector owns the debt or is really just negotiating for the creditor (visa, discover, HSBC etc).</p>

<li> Again, the key is where you live, how much the debt is and who owns the debt. Next, when you get a deal, make it contingent on:</li>

<li>Keeps the debt collector on their best behavior</li>
<li>Ensures that you have a record of the call</li>

<p style="text-align: justify;"><strong>Make sure there&#8217;s a record</strong></p>
<ul style="text-align: justify;">
<li>File all collection letters</li>
<li>Keep detailed notes of collection calls</li>
<li>Note the day and time of each call</li>
<li>The name of the collection agency</li>
<li>The first and last name of the caller</li>
<li>Make a note of what was said</li>
<li>get proof of the deal you&#8217;ve made with them</li>

<p style="text-align: justify;"><strong>Get proof of payment agreement in writing</strong></p>

<li>Send a letter to the debt collector outlining the payment agreement</li>

<li>Remove any negative information they&#8217;ve placed on your credit report</li>
<li>List your account as paid in full rather than paid in settlement</li>
<li>Get it in writing once they agreed</li>
</ul>
<p style="text-align: justify;"><strong>Don&#8217;t be rushed</strong></p>
<ul style="text-align: justify;">
<li>Do not let a debt collector rush you to send them money immediately</li>
<li>Resist all those demands and quick offers</li>
<li>Don&#8217;t pay until you have confirmation of a payment agreement in writing</li>
</ul>
<p style="text-align: justify;">Negotiate at the end of the month</p>
<p style="text-align: justify;">Commissions for debt collectors are based on what they do each month.</p>
<p style="text-align: justify;">If you negotiate at the end of the month you would get really a good deal.</p>

<li>Save all of your phone messages and voice mails.</li>
